Before you create an account or start using the platform, it’s important that you understand how the service works and the rules that apply to your use of it.

Stake.us is operated by Sweepsteaks Limited, a company registered under the laws of Cyprus. The company registration number is HE436222, and its registered office is located at 7 Patrikiou Loumoumba, Block A, Office A13, 7560 Perivolia, Larnaka, Cyprus.

Throughout these Terms, references to “Stake,” “we,” “our,” or “us” mean Sweepsteaks Limited.

Creating an Account

When you sign up through our website, mobile app, tablet, or any other supported device, you are agreeing to these Terms and entering into a legally enforceable agreement with us. These Terms govern your access to and use of the platform, your account, and all available games.

PLEASE READ EVERYTHING CAREFULLY BEFORE ACCEPTING.

By agreeing to these Terms, you confirm that you have reviewed and understood them in full. We rely on that confirmation when allowing access to the platform.

If you are located in any of the restricted regions listed later in these Terms, you are not permitted to register, access the platform, open an account, participate in games, or otherwise interact with Stake.

By checking the acceptance box during registration, creating an account, accessing the platform, or participating in any game, you confirm that:

From time to time, we may revise these Terms. Continued use of the platform after changes are published means you accept those updated Terms. If you do not agree with future revisions, you must stop using the platform and any associated services. The latest version date will always appear at the top of the Terms.

2. STAKE POLICY

2.1 Restricted Locations

The following areas are considered Excluded Territories.

a) Countries Outside the United States

Anyone located outside the continental United States or Hawaii is prohibited from participating.

b) Restricted U.S. States

Residents of the following states are not permitted to use the platform:

2.2 Location Representations

By registering, accessing the platform, opening an account, or playing any game, you are confirming that you are not located in an Excluded Territory.

Stake relies on this statement when providing access.

If you live in or access the platform from a restricted jurisdiction and still proceed despite our preventative measures, we consider that behavior to be:

2.3 No Purchase Required

You do not need to buy anything to participate.

Making a purchase does not improve, increase, or otherwise affect your chances of winning.

2.4 Not Real-Money Gambling

The platform and games are not intended to function as real-money gambling services.

No real-money wager is required in order to participate.

2.5 Eligible Regions

Only customers physically located within the continental United States and Hawaii, excluding all listed restricted jurisdictions, may access the platform, create accounts, and participate in games.

2.6 Arbitration Notice

These Terms contain dispute-resolution requirements that include:

Unless you properly opt out under Section 26, all covered disputes—past, present, or future—must be handled individually through arbitration.

3. DEFINITIONS

For the purposes of these Terms, the following definitions apply:

a) “Collective Action”

Any claim or legal proceeding brought on behalf of multiple people, including class actions, mass actions, coordinated claims, representative actions, private attorney general actions, consolidated proceedings, or similar formats.

b) “Content”

All materials displayed on or made available through the platform, including text, graphics, photos, logos, trademarks, audio, music, artwork, software code, user interfaces, visual elements, and similar materials.

c) “Customer Account”

The account registered and maintained by a user.

d) “Fraudulent Conduct”

Any game offered on the platform, whether played in Standard Play or Promotional Play mode.

Any conduct described as fraudulent under Section 16.

e) “Game”

Stake may add, remove, suspend, or modify games at any time.

f) “Gold Coin”

A virtual entertainment currency used for Standard Play.

Gold Coins have no cash value and cannot be exchanged for prizes, money, or anything else of value.

g) “Participate,” “Participation,” or “Participating”

Any interaction with the platform or games, including activities described throughout Sections 6, 9, 10, 11, and 12.

h) “Payment Administration Agent”

Any payment processor, affiliated entity, contractor, or third-party service provider authorized to facilitate transactions on our behalf.

i) “Payment Medium”

Any approved payment method used to purchase Gold Coins, including cards, bank accounts, wallets, or similar payment instruments.

j) “Platform”

All Stake-branded services, websites, applications, tools, features, games, and related services, including Stake.us and all related domains, pages, and successor services.

k) “Customer” or “You”

Any individual who uses the platform or participates in any way, whether registered or not.

l) “Prize”

A redeemable reward that may be obtained through qualifying Promotional Play using Stake Cash.

m) “Promotional Play” or “Sweepstakes”

Participation in sweepstakes-style promotions through the use of Stake Cash.

n) “Registered Customer”

A user who has successfully created a Customer Account, regardless of whether the account is currently active.

o) “Standard Play”

Gameplay conducted using Gold Coins.

p) “Stake Cash”

Sweepstakes entries used within Promotional Play.

q) “Third-Party Website”

Any website or online service that is not owned or controlled by Stake.

4. ACCOUNT REGISTRATION AND CUSTOMER PROMISES

4.1 Registration Requirements

a) Information We Collect

When creating an account, you may be required to provide:

  1. Your legal first and last name;
  2. Your date of birth;
  3. Your residential address;
  4. Your email address.

b) Identity Verification

To verify your identity, we may ask you to provide:

The identification document must be valid and acceptable for identity verification purposes and may need to display your residential address.

You will also create:

Information regarding how we collect, store, use, and disclose personal data is explained in our Privacy Policy.

4.2 Customer Representations and Guarantees

a) By using the platform, you confirm that:

i. You are at least 21 years old, or any higher minimum age required by the laws that apply where you live, and you are legally permitted to participate.

ii. When using Standard Play or Promotional Play, you are not located in any Excluded Territory.

iii. You are using the platform strictly for personal enjoyment and recreational purposes.

iv. You are participating on your own behalf and not acting for another individual.

v. All information you provide is accurate, complete, and truthful, and you will promptly update us if anything changes.

vi. Any cryptocurrency or traditional currency used to purchase Gold Coins comes from legitimate sources and is not connected to unlawful activity.

vii. Gold Coin purchases will only be made using accounts or wallets registered in your own name and not through business or corporate accounts.

viii. You will not engage in cheating, collusion, manipulation, match-fixing, fraud, or any other unlawful conduct, and you will not use bots, automation software, scripts, hardware tools, or similar assistance when participating.

If such activity is detected, Stake may invalidate affected participation.

ix. Any payment method used for purchases belongs to you and is legally authorized for your use.

b) Legal Responsibility

You alone are responsible for determining whether your participation is lawful under the laws that apply to you.

c) Circumvention of Restrictions

Anyone who knowingly violates Sections 2, 4, or 23—including attempts to bypass geographic restrictions through VPNs, location-masking tools, proxy services, inaccurate information, or participation through another person—will be considered in breach of these Terms.

Such conduct may also constitute fraud and could expose you to legal or criminal consequences.

d) You may not engage in conduct that is threatening, defamatory, abusive, or damaging to another person’s reputation.

e) You may not participate in suspicious, deceptive, or potentially fraudulent activities or transactions.

f) You agree to cooperate with identity checks, investigations, and requests for verification relating to your account or information.

g) You must not provide information that is false, incomplete, deceptive, or misleading when using the platform or communicating with Stake.

h) You must not infringe—or attempt to infringe—any applicable law or any intellectual property, privacy, publicity, trademark, patent, copyright, or proprietary rights belonging to Stake or another party.

i) You confirm that your use of the platform, participation in games, and compliance with these Terms will not violate any applicable law, regulation, court order, governmental directive, arbitration award, or similar legal requirement.

4.3 Who Cannot Participate

The following individuals are not eligible to participate:

This restriction applies whether the relationship arises through birth, marriage, or adoption.

Household members who share the same residence for at least three months of the year are likewise ineligible.

4.4 Acceptance of Risk

By accepting these Terms and participating on the platform, you acknowledge that all participation is undertaken entirely at your own choice, discretion, and risk.

You agree that you will not bring claims against Stake, its affiliates, partners, officers, directors, employees, contractors, or representatives in connection with your use of the platform or participation in the games.

5. ACCESS RIGHTS

5.1 Your Permission to Use the Platform

As long as you continue following these Terms and Conditions, Stake gives you a limited permission to use its platform. This permission is personal to you, cannot be transferred to anyone else, cannot be sublicensed, and can be revoked at any time if necessary.

This authorization allows you to access and use the Platform, including Gold Coins and Stake Cash, through supported browsers and mobile devices. The Platform may only be used for your own personal entertainment and private enjoyment. It may not be used for commercial purposes or any purpose outside what is specifically allowed under these Terms.

5.2 Ownership Remains with Stake

Nothing in these Terms gives you ownership rights over the Platform, its software, games, content, systems, branding, or any other materials available through the service. Your permission is limited to using the Platform in accordance with these Terms.

5.3 Limits of Your License

You understand and agree that your right to use the Platform exists only while you continue complying with these Terms.

If you violate any part of these Terms, or if you refuse to comply with them, your authorization to use the Platform, including any Games, Content, Gold Coins, or Stake Cash, may be ended automatically and immediately by Stake without any obligation or liability toward you.

5.4 Jurisdiction Restrictions

If the laws where you live or are currently located prohibit the use of the Platform or any specific Game, then no permission is granted to you to access or use those services. In those circumstances, you must not attempt to access the Platform or participate in the relevant Game.

6. YOUR CUSTOMER ACCOUNT

6.1 One Account Per Person

a) Each user is permitted to maintain only a single Customer Account on the Platform. This restriction applies whether the account is currently active or inactive.

If you create, attempt to create, or maintain multiple Customer Accounts, Stake may suspend or permanently close any affected accounts. Additional consequences described elsewhere in these Terms, including those referenced in Clause 23, may also apply.

b) If you discover that more than one Customer Account has been registered under your details, whether intentionally or accidentally, you must notify us as soon as possible.

c) If you need to update your email address, residential address, or any other personal information, do not create a new account. Instead, update the existing account through the appropriate process.

6.2 Keeping Information Accurate

a) You are responsible for ensuring that all information connected to your account remains accurate and current at all times.

b) The personal information you provide during registration, or any updates made later, must exactly match the details shown on your government-issued identification documents.

6.3 Account Security and Your Responsibilities

a) During registration, you will be asked to create a password that will be used to access your account.

b) Protecting your login credentials and payment methods is entirely your responsibility. You must ensure they remain secure and accessible only to you.

You accept responsibility for all activity connected to your account, including activity carried out by unauthorized individuals or minors, even though minors are not permitted to use the Platform.

c) Stake strongly encourages all users to enable multi-factor authentication to add an additional layer of protection to their accounts.

d) You must never share your password or account access with another person. Likewise, you must not allow anyone else to log into your account or take any action that could compromise its security.

e) If you believe your account credentials have been lost, stolen, exposed, or otherwise compromised, you must contact us immediately.

f) You are fully responsible for keeping your password confidential. Any purchases, transactions, or activity conducted through your account will be considered your responsibility regardless of whether you personally authorized them.

g) Everything that happens through your account remains your responsibility, whether you personally carried out the action or not.

h) You acknowledge that Stake may suspend or terminate your account if another person accesses it or if activity occurs that violates these Terms or applicable laws.

i) Stake is not liable for misuse of your account resulting from you sharing login details with someone else, whether intentionally, accidentally, directly, or indirectly.

6.4 Transfers and Trading of Accounts or Virtual Currency

a) Gold Coins and Stake Cash cannot be transferred between accounts.

You may not:

b) Gold Coins and Stake Cash are separate virtual items and cannot be exchanged for one another.

c) Buying, selling, transferring, acquiring, or attempting to acquire Customer Accounts is strictly prohibited.

If Stake determines that you have engaged in any of these activities, any associated accounts may be closed immediately at Stake’s sole discretion, without compensation or liability. Additional enforcement measures described in Clause 23 may also be applied.

6.5 Closing Your Account

a) If you decide you no longer want to use the Platform, you may request closure of your account by emailing accountclosure@stake.us.

Once your account is closed, you lose access to any Gold Coins, Stake Cash, and any prizes that have not yet been redeemed. These items will be forfeited and can no longer be used or recovered.

b) If your reason for closing your account involves concerns about responsible gameplay, we encourage you to review the Gameplay Self-Exclusion Policy available through the Platform.

c) Unless your account has been self-excluded, you may request to reopen it by contacting accountclosure@stake.us.

All reopening requests are reviewed by Customer Support and Compliance teams. These reviews are conducted according to customer protection procedures and applicable legal requirements.

6.6 Stake’s Right to Refuse or Close Accounts

Stake may, at any time and for any reason it considers appropriate, place restrictions on an account, suspend an account, close an account, or decline a registration request.

These decisions are entirely within Stake’s discretion and may be made without liability to you.

7. GOLD COINS

7.1 Understanding Gold Coins

a) Gold Coins are virtual entertainment credits intended solely for Standard Play games.

They do not represent real money, have no cash value, and cannot be redeemed, exchanged, or converted into anything of monetary value.

b) Stake may provide free Gold Coins through several methods, including:

i. Daily Login Rewards

Users can receive Gold Coins once each day by signing into their Customer Account and claiming the daily reward.

ii. Promotional Events

Stake may occasionally distribute Gold Coins through contests, giveaways, or promotions conducted through social media channels such as Facebook, Instagram, Twitter, or similar platforms.

c) Additional Gold Coins may also be obtained by winning them through Standard Play or by purchasing them directly through the Platform.

d) Standard Play does not provide eligibility for prizes or prize redemption.

7.2 Purchasing Gold Coins

a) When you purchase Gold Coins, you are purchasing a license that allows participation in Standard Play.

This is not a deposit and does not create any withdrawable balance.

Money used to obtain Gold Coins is non-refundable. Gold Coins themselves have no real-world monetary worth.

b) Gold Coins may be purchased using payment options made available through the Platform.

c) Any payment method used to purchase Gold Coins must belong to you personally and be registered in your own name.

If Stake discovers that the name attached to a payment method does not match the name associated with your Customer Account, your account may be suspended immediately.

Should this happen, you are encouraged to contact Customer Support at support@stake.us.

d) Stake may request documents or information to verify ownership of any payment method used for purchases.

e) You authorize Stake and any approved payment processing partners to securely retain payment information for future transactions in accordance with applicable payment regulations.

f) After a purchase is completed, payment will be collected from your selected payment method as soon as reasonably possible.

g) The maximum amount of Gold Coins that may be purchased is USD $9,000 during any single day.

h) If a purchase is reversed, disputed, returned, charged back, or otherwise cancelled after processing, your account may be suspended.

Any reversed amount will become a debt owed by you to Stake.

You must repay that amount using an alternative payment method. Until repayment is received, your account will remain suspended, any affected purchases may be cancelled, and requests to redeem Stake Cash will not be processed.

7.3 Accepted Currencies

a) Gold Coins may be purchased using supported cryptocurrencies or approved fiat currencies.

b) Any transaction costs, conversion fees, banking charges, network fees, exchange rate losses, or similar expenses connected to your purchases are your responsibility alone.

c) If you buy Gold Coins using fiat currency, any future Stake Cash redemption must also be completed using fiat currency.

If you buy Gold Coins using cryptocurrency, any redemption of Stake Cash must be completed using cryptocurrency.

You may only switch between fiat and cryptocurrency once your Stake Cash balance has reached zero.

As long as Stake Cash remains in your account, you cannot change between fiat and cryptocurrency for purchases or redemptions.

8. STAKE CASH

8.1 What Stake Cash Is

a) Promotional Stake Cash can be used to participate in Promotional Play games available on the Platform.

Stake Cash is restricted to Promotional Play and cannot be used for Standard Play.

b) Stake Cash cannot be purchased.

It is available only through promotional methods and free distribution programs.

8.2 Ways to Receive Stake Cash

a) Free Stake Cash may be awarded through the following methods:

i. Daily Login Rewards

Customers can claim Stake Cash once per day by logging into their account and collecting the available daily reward.

ii. Promotional Giveaways

Stake may offer Stake Cash through promotions conducted on social media platforms. The amount awarded will be specified in the promotion itself.

iii. Postcard Requests

Customers may obtain five free Stake Cash by submitting a qualifying postcard request in accordance with the rules outlined below.

b) Occasionally, Stake may include promotional Stake Cash bonuses with selected Gold Coin purchases.

Where applicable, the amount of bonus Stake Cash included with a qualifying purchase will be displayed at the time of purchase.

All Gold Coin purchases remain final and non-refundable.

c) Using bots, scripts, automated software, or any system designed to obtain Stake Cash or participate automatically is strictly prohibited and may result in disqualification and loss of participation privileges.

8.3 Obtaining Stake Cash Through Mail Requests

a) Customers may request five free Stake Cash by mailing a standard postcard or white sheet of paper measuring at least 4 inches by 6 inches.

The request must be placed inside a stamped envelope and mailed to:

b) The envelope and request card must satisfy all requirements outlined below:

i. The outside of the envelope must contain:

ii. On one side only of the enclosed request card, you must handwrite the following information in exactly this order:

  1. Your full legal name exactly as it appears on your government-issued identification.
  2. Your Stake.us username.
  3. The residential address associated with your Stake.us account.
  4. The email address linked to your Stake.us account.
  5. The word “CODE:” followed by a valid unique postcard code generated for your account.
  6. The following statement:

“I wish to receive Stake Cash to participate in the sweepstakes promotions offered by Stake Sweepstakes. By submitting this request, I hereby declare that I have read, understood and agree to be bound by Stake’s Terms and Conditions.”

g) Only one request card may be included in each outer envelope.

h) All handwriting must be clearly legible.

If any information cannot reasonably be read, the submission may be rejected and no Stake Cash will be credited.

Stake alone will determine whether handwriting is sufficiently legible.

Handwritten means personally written by the customer. Templates, stencils, copies, printing devices, or similar methods are not permitted.

i) Requests must be submitted personally by the account holder and mailed from the same state or province associated with the verified residential address on the account.

Submissions sent by third parties, commercial services, or from different locations may be rejected.

j) Stake may reject requests originating from Excluded Territories.

k) Requests mailed from prohibited locations or submitted on behalf of another person will not qualify.

l) Any attempt to manipulate, automate, abuse, or interfere with the request process may result in disqualification.

Where identity disputes or eligibility questions cannot be resolved to Stake’s satisfaction, the request may be deemed invalid.

m) Any submission lacking a valid unique postcard code will be rejected.

n) Each approved Request Card earns five Stake Cash.

8.4 Stake Cash Balances

a) Your current Stake Cash balance will be displayed within your Customer Account.

b) Stake may modify, increase, reduce, or otherwise change Stake Cash allocations at any time and at its sole discretion.

c) Stake is not responsible for requests that are lost, delayed, incomplete, misdirected, invalid, damaged, or otherwise unable to be processed.

9. GAMES

9.1. How the Games Work

a) To take part in either Standard Play or Promotional Play, you first need an active Customer Account and you have to agree to these Terms before doing anything else.

b) You can only join a Game if your account has enough Gold Coins or Stake Cash (depending on which mode you’re playing).

c) Each Game on the Platform might come with its own specific rules, and those rules are always shown on the Platform itself. It’s on you to read and understand those rules before you start playing, because once you play, you’re agreeing to them just like these Terms.

d) Once you commit Gold Coins or Stake Cash to a Game and it gets accepted by the system, it’s final. You can’t edit it, cancel it, or take it back, and the balance will be deducted immediately.

9.2. Cancelled or Invalid Games

Stake can cancel a Game or void participation in it, either fully or partially, if we believe something clearly went wrong. This could be anything like a bug, typo, wrong payout setup, incorrect odds, or any kind of technical issue affecting the Game. We decide this at our own discretion.

9.3. What Counts as the Official Result

If what you see on your device doesn’t match what shows on Stake’s servers, the version on Stake’s servers is the one that counts as final and correct.

10. STANDARD PLAY

10.1. Standard Play is only available using Gold Coins.

10.2. When you play Standard mode, any winnings you get will also be in Gold Coins only.

10.3. You can’t win real money or any redeemable prizes through Standard Play.

11. PROMOTIONAL PLAY / SWEEPSTAKES

11.1. Promotional Play (also called Sweepstakes) only works using Stake Cash.

11.2. It’s your responsibility to make sure this type of play is legal where you live. We don’t guarantee compliance for your local laws.

11.3. The Platform has different Games available, and each one will show clearly how much Stake Cash is needed and what rules apply before you play it.

11.4. Only Stake Cash used in Promotional Play can lead to redeemable Prizes. If a prize is available, you’ll see it in the Platform when you click the “Redeem” option.

11.5. All decisions made by Stake regarding how the Sweepstakes run, how Games operate, and what prizes are available are final and binding.

12. PROMOTIONS

12.1. Any promotion, contest, or special offer (including Promotional Play) is covered by these Terms, plus any extra rules that are posted when the promotion is live.

12.2. If there’s ever a conflict between these Terms and the promotion-specific rules, the promotion rules will override these Terms for that specific situation.

12.3. Stake can change, pause, or remove promotions at any time without warning, and we are not responsible for any impact that causes.

12.4. If we think a user is abusing a promotion in any way—like trying to cheat, exploit it, or gain unfair advantage—we can remove rewards, block bonuses, or cancel entries entirely, at our sole discretion.

12.5. Unless restricted by Clause 17, anything you submit or post as part of a promotion or contest gives Stake a permanent, worldwide, royalty-free license to use that content in any way we want, without needing to credit you again.

13. REDEMPTION OF PRIZES

13.1. Prize Rules

a) Only Promotional Play (Sweepstakes) gives access to redeemable Prizes. Standard Play does not.

b) You can only redeem Stake Cash for Prizes.

c) Except for Stake Cash that is directly won through Promotional Play, you need to wager your Stake Cash at least three times before you’re allowed to redeem it.

d) Stake can change prize structures, odds, and win rates at any time. It’s your responsibility to check how things work before playing.

e) You won’t be able to redeem any Prize unless you complete any identity checks we request.

13.2. What You Can Redeem For

a) The available Prize options are shown on the Platform and may change whenever Stake decides.

b) These may include, but aren’t limited to:

i. Cryptocurrency (if conditions are met)

ii. Fiat currency (if conditions are met)

13.3. Limits and Charges

a) Stake may apply fees for processing Prize withdrawals and may also set minimum withdrawal amounts.

b) In Florida, Prize redemptions from Sweepstakes participation are capped at USD $5,000 per day. Anything above that limit won’t be paid out.

13.4. Redeeming Cryptocurrency

a) To redeem into crypto, you go into your Wallet, click “Redeem,” and choose the cryptocurrency you want.

b) You are fully responsible for making sure the crypto wallet you use can actually receive the funds. Stake doesn’t verify wallet compatibility.

c) Stake Cash is treated as 1 Stake Cash = 1 USD in value. The actual crypto amount you receive depends on the market price at the time of redemption.

d) You can only redeem using the same crypto method you originally used when buying Gold Coins, and only if you meet the requirements in Clause 7.3(c).

13.5. Redeeming Fiat Currency

a) Fiat redemption is only allowed if you’ve met the requirements in Clause 7.3(c).

b) To cash out in fiat, you select Wallet, press “Redeem,” and choose your currency.

c) You must ensure your bank account can accept the transfer—this is your responsibility.

d) Stake Cash is valued at 1 Stake Cash = 1 USD, and fiat payouts are based on current exchange rates.

13.6. Processing Times and Limits

a) Redemption requests are handled in the order they come in, and we aim to process them as quickly as possible.

b) Only one redemption request per account can be processed within any 24-hour period.

c) Verification checks can delay payouts, and Stake isn’t responsible for delays caused by these processes or third-party payment systems.

d) We may also split large payouts into smaller installments over time instead of paying them all at once.

13.7. Errors and Incorrect Credits

If your account is accidentally credited with funds or prizes that don’t belong to you, that amount remains Stake’s property and will be removed. If you already spent or withdrew it before the error is found, it becomes a debt you owe back to Stake.

If you notice something like this, you must contact support immediately at support@stake.us.

14. VERIFICATION

14.1. Identity Checks

a) We can request identity, credit, or other verification checks whenever needed, either for legal compliance or fraud prevention.

b) Until verification is completed:

i. Any redemption request will stay on hold.

ii. We may restrict, freeze, or suspend your account.

c) If you don’t provide required documents within 30 days of the request, we may stop the verification process and suspend or close your account at our discretion.

d) If your account is suspended or closed and you want to discuss redemption, you should contact support at support@stake.us.

14.2. Third-Party Verification

We may also use external service providers to run identity and compliance checks based on the information you provide.

15. RESPONSIBLE SOCIAL GAMEPLAY

15.1. Our Approach

a) Stake promotes responsible gaming and encourages users to take advantage of tools that help manage play, spending, and time.

b) We do our best to support safe gameplay, but we aren’t responsible if someone ignores these tools or finds ways to bypass them, especially in situations outside our control.

15.2. Self-Exclusion

At any time, you can request a break or fully self-exclude from gameplay. Instructions and the process for doing this are available here.

16. FRAUDULENT CONDUCT

16.1. As a requirement for being allowed to use the Platform or access the Games, you are strictly prohibited from doing, either directly or indirectly, any of the following:

a) trying to break into any part of the Platform or Games by guessing passwords, phishing attempts, or any other unauthorized method of access;

b) attempting to copy, reverse engineer, decompile, or otherwise pull apart any component of the Platform or Games;

c) introducing or distributing any harmful software or code such as viruses, worms, trojans, spyware, malware, logic bombs, or anything similar in nature;

d) bypassing or interfering with how the Platform or any Game is structured or displayed in order to access information that Stake has intentionally kept hidden from public view;

e) participating in any kind of cheating behavior, teaming up dishonestly, or colluding with others to gain unfair advantage;

f) using the Platform or Stake systems in any way that helps facilitate illegal financial activity, including laundering money or processing funds from unlawful sources;

g) getting involved in, encouraging, or benefiting from any schemes, groups, or arrangements intended to:

i. distribute special promotional offers or bonus links that were meant only for specific customers; or

ii. misuse or share identity documents (such as utility bills, IDs, or rental agreements) to mislead Stake about who a customer really is.

16.2. You are not allowed to use the Platform for any illegal, dishonest, or unauthorized financial activity, including anything that would be considered Fraudulent Conduct under any laws that apply to you. All transactions may be monitored as part of anti–money laundering and compliance procedures.

16.3. If Stake has any reason to believe you are involved in fraud, illegal actions, money laundering, or any behavior that breaks these Terms, your account access may be suspended right away and your Customer Account may also be restricted or closed at Stake’s sole discretion. If this happens, Stake is not required to refund any purchases of Gold Coins or allow redemption of any Stake Cash in your account. Stake may also report the matter to law enforcement, financial institutions, payment providers, or other relevant organizations. You agree to fully cooperate with any investigation conducted by Stake regarding such matters.

16.4. If you think another user is doing something suspicious, illegal, or breaking the rules, you should report it immediately using the official Customer Complaints or support channels provided on the Platform.

17. INTELLECTUAL PROPERTY

17.1. All software, graphics, design elements, user interface components, and other technology or materials provided through the Platform are owned by Stake or licensed to Stake and are protected by copyright and other intellectual property laws. You are only allowed to use them for personal entertainment purposes in accordance with these Terms and all applicable laws.

17.2. You acknowledge that Stake either owns or legally holds rights to all intellectual property connected to the Content available on the Platform.

17.3. Using the Platform or Games does not give you any ownership rights or intellectual property rights over any Content, software, or materials you interact with.

17.4. By posting or uploading any content to Stake’s websites, social media pages, or platforms, you give Stake permission to use that content in any way, anywhere in the world, permanently and without paying you, and you confirm you have the right to grant this permission.

17.5. You are not allowed to copy, alter, reuse, or redistribute any Content from the Platform, including removing copyright notices, trademarks, or branding.

17.6. Any trademarks, logos, or brand identifiers shown on the Platform belong to their respective owners and are protected by intellectual property laws.

18. THIRD PARTY WEBSITES, LINKS OR GAMES

18.1. Third Party Websites

a) You understand and agree that Stake has no control over third-party websites and is not responsible for their content, accuracy, security, or how they function.

b) You also understand that any third-party sites claiming to offer Gold Coins or Stake Cash are not authorized by Stake. These sites may be scams designed to steal your personal information like passwords or payment details. Stake is not responsible for anything that happens if you interact with those websites.

18.2. Links

a) Any links that lead to third-party websites do not mean that Stake is connected to, partnered with, or endorsing those websites or their services, unless explicitly stated otherwise.

b) If Stake provides links to social media platforms like Facebook or Twitter, you agree that:

i. anything you post there is governed by that platform’s own rules and policies;

ii. you will not post anything false, misleading, harmful, or defamatory about Stake, its staff, or other users;

iii. Stake is not responsible for any content posted by you or anyone else on those external platforms.

19. DISRUPTIONS AND CHANGE

19.1. No warranties

The Platform is provided “as is,” meaning Stake does not guarantee or promise that everything will always be perfect, accurate, or suitable for any specific purpose, to the fullest extent allowed by law.

19.2. Malfunctions

a) Stake does not guarantee that the Platform, your account access, or the Games will always be available, uninterrupted, timely, or completely error-free.

b) Stake is not responsible for any downtime, server issues, lag, technical failures, or disruptions caused by external events or any attempts to use the Platform in unintended ways.

c) Stake is not liable for any damages or losses related to Platform use, including but not limited to delays, interruptions, data loss, communication failures, misuse of the Platform, or errors in content.

d) If a system error or malfunction occurs, any gameplay affected by that issue will be considered invalid.

e) If a Game starts but cannot finish due to a technical failure, Stake will make reasonable efforts to restore the Gold Coins or Stake Cash used in that game back to your account.

f) Stake may adjust or correct account balances if errors or system issues affect them.

g) Stake may remove or change any part of the Games at any time. If bugs or misconfigurations cause incorrect results, balances, or Prize outcomes, those results may be canceled, corrected, or removed.

19.3. Change

Stake can change, update, suspend, or remove any part of the Platform or its Content at any time without warning. Stake is not responsible for any losses that result from such changes.

19.4. Service Suspension

The Platform may be temporarily suspended in whole or in part whenever necessary, at Stake’s discretion. Notice may be given where possible, but is not required. Services will resume as soon as reasonably possible.

19.5 Viruses

While Stake takes reasonable steps to keep the Platform secure, it cannot guarantee it will always be free of viruses or harmful software. You are responsible for protecting your own device and data backups.

20. PRIVACY POLICY

20.1. Stake respects your privacy and follows applicable data protection laws and regulations.

20.2. The Privacy Policy forms part of these Terms and must be accepted in order to create an account.

20.3. By using the Platform, you agree to receive marketing messages from Stake via email or notifications, which you can opt out of anytime by contacting support at support@stake.us.

21. USE OF LIVE CHAT SERVICES

21.1. Live Chat may be provided for communication with support staff or other users. It must only be used for its intended purpose and not for illegal activity.

21.2. All chat activity may be monitored and recorded. You should treat it as a public, recreational space and communicate appropriately.

21.3. Spamming, harassment, intimidation, or abusive behavior in chat is not allowed.

21.4. You must not use chat to post threatening, offensive, discriminatory, explicit, obscene, or defamatory messages.

21.5. You must not use chat to violate anyone’s privacy, property rights, or other legal rights.

21.6. You are not allowed to post or share anything unlawful or misleading through chat.

21.7. You must not use chat to advertise, promote services, or request money or outside transactions.

21.8. You must not share malicious software, links, or anything that could harm the Platform or other users’ devices.

21.9. Stake may monitor chat content at any time to ensure compliance with rules, which may change.

21.10. Violations may result in chat bans, account suspension, or permanent account deactivation, and may affect Prize eligibility.

21.11. Stake may remove chat features if they are misused.

21.12. Stake is not responsible for any harm resulting from chat usage.

21.13. You agree to protect and indemnify Stake against any claims arising from your misuse of chat features or violations of these rules.

21.14. Collusion or coordinated cheating through chat is strictly forbidden, and suspicious activity should be reported to support.

22. COMPLAINTS AND CUSTOMER SUPPORT

22.1. You can contact support anytime at support@stake.us for questions, complaints, or assistance.

22.2. For security reasons, all communication must come from the email linked to your account. If not, you may be asked to verify ownership before assistance continues.

22.3. Any complaint must include:

a) your username;

b) your full name as registered;

c) a clear explanation of the issue;

d) relevant dates and times if applicable.

22.4. Missing information may delay how quickly your issue can be handled.

22.5. Stake aims to respond as quickly as reasonably possible after receiving your message.

22.6. Abusive, threatening, or spam-like messages to support staff are not allowed. If this occurs, Stake may stop responding, suspend your account, or restrict Prize redemption rights.

23. DEACTIVATION/SUSPENSION OF ACCOUNT

23.1. Without limiting anything stated in clause 4, Stake can, at its own sole discretion, temporarily suspend or permanently deactivate your Customer Account at any time if there is reason to believe you may have done, or are about to do, any of the following:

a) breaking these Terms yourself, or helping someone else break them, or where there is reasonable suspicion that such a breach has happened;

b) operating more than one Customer Account on the Platform, including accounts that are inactive or not currently in use;

c) having mismatched details between your Customer Account name and the name linked to (i) the Payment Method used to buy Gold Coins or (ii) the account used for receiving Prizes, or if you are not the actual legal owner of that payment or withdrawal method;

d) using language or communication that is abusive, threatening, offensive, discriminatory, harassing, defamatory, obscene, sexually explicit, or otherwise inappropriate toward Stake or other users;

e) your account being considered inactive for a period of time, based on Stake’s own judgement;

f) becoming bankrupt or entering insolvency proceedings;

g) providing false, incomplete, or misleading information at any point;

h) being unable to verify your identity, source of funds, or source of wealth when requested;

i) accessing or trying to access the Platform using VPNs, proxies, or similar tools to hide or alter your real location, or providing false details about where you live, or playing through another person or on behalf of someone else;

j) not meeting the minimum age requirement of 21 years or any higher age requirement depending on your jurisdiction;

k) being located in a place where using the Platform is illegal;

l) allowing someone else, intentionally or unintentionally, to use your Customer Account;

m) coordinating gameplay with other users in a group, club, or any form of collusion involving shared or matching strategies or selections;

n) receiving chargebacks, payment disputes, or reversal notifications connected to your Payment Method;

o) failing compliance checks, or being suspected (at Stake’s sole discretion) of fraud, cheating, money laundering, or any similar illegal or improper conduct;

p) using bots, scripts, automation tools, machines, software, or any system designed to gain an unfair advantage in gameplay.

23.2. Stake may also suspend any Customer Account whenever it believes such action is needed to protect the Platform, other users, or the general public, without needing to provide justification.

23.3. If your account is suspended or closed due to the reasons listed in clause 23.1, you may be responsible for any losses, damages, claims, costs, or expenses incurred by Stake as a result. You agree that Stake can recover these amounts from you and that you will compensate Stake if requested.

23.4. If Stake reasonably believes that any activity described in clause 23.1 has taken place, it may withhold, freeze, or recover any Gold Coins, Stake Cash, or Prizes connected to that activity. Stake may also share your information with regulators, law enforcement, or financial institutions where necessary.

23.5. If your account is closed due to Platform shutdown or similar reasons, Stake will make reasonable efforts to allow redemption of any eligible Prizes, but all rights to use Gold Coins and Stake Cash will end.

23.6. All rights in this clause exist in addition to any other rights Stake may have under these Terms or applicable law.

24. INDEMNITY AND LIMITATION OF LIABILITY

24.1. Indemnity

YOU AGREE THAT YOU WILL FULLY INDEMNIFY AND HOLD HARMLESS STAKE AND ALL RELATED ENTITIES, INCLUDING AFFILIATES, SUBSIDIARIES, PARENT COMPANIES, PARTNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, SHAREHOLDERS, AGENTS, LICENSORS, AND SUPPLIERS (“INDEMNIFIED PARTIES”) FROM ANY AND ALL CLAIMS, DISPUTES, DEMANDS, ACTIONS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING LEGAL FEES) ARISING OUT OF OR CONNECTED TO:

a) your access to or inability to access the Platform;

b) any breach or suspected breach of these Terms by you;

c) violation of any applicable law or regulation by you;

d) infringement of third-party rights;

e) your reuse, distribution, or misuse of Platform Content;

f) any payment activity connected to your Customer Account;

g) participation in any Game or use of the Platform;

h) acceptance, use, or inability to use any Prize.

24.2. Limitation of Liability

a) TO THE MAXIMUM EXTENT ALLOWED BY LAW, STAKE AND ITS AFFILIATES AND RELATED ENTITIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF BUSINESS, REVENUE LOSS, OR ANY OTHER INTANGIBLE LOSSES ARISING FROM YOUR USE OF THE PLATFORM OR THESE TERMS.

i) Stake’s total liability, under any legal theory, will not exceed the total amount you have paid in the thirty (30) days before any claim is made. If you have not made any payments during that time, your only remedy is to stop using the Platform and close your account.

b) You acknowledge that these liability limits, disclaimers, and indemnity obligations are essential parts of this agreement and were factored into your decision to accept these Terms.

c) Stake is not responsible for delays or failures caused by events outside its control or by legal or regulatory obligations.

d) Some jurisdictions may not allow certain limitations, and in those cases, those limitations will only apply to the extent permitted by law.

e) If you reside in California, you waive California Civil Code §1542, which limits unknown claims at the time of release.

24.3. Negligence and Willful Misconduct

Nothing in these Terms excludes liability for death or personal injury caused directly by Stake’s gross negligence or intentional misconduct.

24.4. Survival of Obligations

This clause 24 remains valid even after these Terms end for any reason.

25. STAKE NOT A FINANCIAL INSTITUTION

25.1. You acknowledge that Stake does not operate as a bank or financial institution, and no interest is earned on any balances or Prizes.

25.2. Stake does not provide financial, tax, or legal advice. If you need such advice, you must consult a qualified professional.

26. DISPUTE RESOLUTION AND AGREEMENT TO ARBITRATE

26.1. THIS SECTION AFFECTS YOUR LEGAL RIGHTS. IT REQUIRES THAT DISPUTES BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION AND LIMITS YOUR ABILITY TO PURSUE COURT ACTION.

26.2. This clause is governed by the Federal Arbitration Act.

26.3. By agreeing to these Terms, you accept that all disputes, claims, or controversies of any kind between you and Stake (including affiliates, employees, and related entities) will be resolved under this arbitration process, including disputes about validity, enforceability, or scope of this clause.

26.4. You understand that agreeing to arbitration is a serious legal decision and you are encouraged to seek independent legal advice if needed.

26.5. Before starting arbitration, you agree to first attempt informal resolution by contacting Stake through the complaint process in clause 22. Arbitration can only begin after those steps are completed. Settlement discussions will remain confidential from the arbitrator until a decision is made.

26.6. Arbitration Process

a) Both parties agree to binding arbitration administered by the American Arbitration Association (AAA). You waive the right to go to court or have a jury trial. The arbitration will be handled by a single neutral arbitrator in English and will generally take place virtually unless otherwise agreed. Discovery will be limited, and smaller disputes under $25,000 may be resolved through documents only. AAA procedures are available at adr.org or 1-800-778-7879.

b) Arbitration details, evidence, and outcomes must remain confidential unless disclosure is legally required.

c) Both parties agree not to challenge the AAA’s authority or jurisdiction.

26.7. Individual Basis Only

a) Disputes must be brought individually and not as part of any class, group, or collective proceeding.

b) Multiple coordinated claims filed together may be treated as a collective action and are not permitted.

c) “Concurrently” means claims that exist at the same time, even if filed separately.

26.8. Waiver of Collective Actions

a) You and Stake both waive the right to participate in class actions or collective legal proceedings of any kind.

b) You also waive the right to a jury trial. If any part of this waiver is found unenforceable, only that specific claim may proceed in court while the rest remains in arbitration.

c) If any part of this clause is invalid, Stake may choose to void the entire arbitration agreement.

26.9. Opt-Out Option

You may opt out of arbitration by sending written notice within 30 days of account creation (or by the stated deadline), sent to Sweepsteaks Limited, 1717 Pennsylvania Ave NW, Suite 650, Washington, DC 20006. If you opt out, neither party is bound by arbitration. If you do not opt out in time, arbitration rules automatically apply.

26.10. This clause survives termination of the Terms.

27. DEATH OF A CUSTOMER

27.1. Notification Requirement

If a customer passes away, their legal representative must notify Stake within 60 days and provide official documentation, including:

a) certified death certificate;

b) legal proof of authority (such as probate or letters of administration);

c) valid ID of the representative.

27.2. Account Status

Once notified, Stake will secure the account to prevent unauthorized access.

27.3. Transfer of Funds or Assets

a) Any Stake Cash may be processed for redemption and any eligible Prizes may be transferred to the estate once proper documentation is verified.

b) Stake may require indemnity protections before releasing funds or assets.

27.4. Account Closure

After verification and transfer, the account will be closed.

27.5. Liability

Any debts or obligations tied to the account remain the responsibility of the estate. Stake may delay or adjust actions if needed to handle legal risks.

27.6. Disputes

If there is disagreement among heirs, Stake will not act until a court order or unanimous agreement is provided.

27.7. Contact

All notices must be sent to support@stake.us or official support channels.

27.8. General

Stake may request additional documents and take reasonable steps to comply with legal obligations and protect its interests.

28. OTHER

28.1. Entire Agreement

These Terms represent the full agreement between you and Stake and replace any previous understandings or communications.

28.2. Amendments

Stake may update these Terms at any time. Updates take effect once posted. Continued use means acceptance.

28.3. Tax

You are responsible for any taxes related to Prizes or redemptions.

28.4. Force Majeure

Stake is not responsible for delays or failures caused by events outside its control.

28.5. No agency

No partnership, agency, or joint venture is created by these Terms.

28.6. Severability

If any part of these Terms is invalid, the rest remains in force, and the invalid part may be adjusted to reflect original intent.

28.7. Explanation of Terms

If you need clarification, contact support. These Terms override any informal communication.

28.8. Assignment

You cannot transfer your rights under these Terms. Stake may assign its rights freely.

28.9. Business Transfers

If Stake is sold or merged, your account may be transferred, and you will be notified.

28.10. Language

The English version of these Terms is the controlling legal document.

28.11 Notices

Legal notices must be sent to Stake’s registered address in Cyprus and support@stake.us. The postcard address is only for that specific purpose.

  1. GOVERNING LAW

29.1. These Terms are governed by the laws of Delaware, USA, without conflict-of-law rules.

29.2. Except for arbitration matters, disputes will be handled in Delaware courts, which you agree have jurisdiction. Arbitration enforcement may occur in any competent court.
